RiskyInvests.com respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA). This policy outlines the procedures for reporting alleged copyright infringement on our Site and how we respond to such claims.
1. Reporting Copyright Infringement (DMCA Takedown Notice)
If you are a copyright owner or an agent thereof and believe that any content on RiskyInvests.com infringes upon your copyrights, you may submit a formal notification of claimed infringement (“DMCA Takedown Notice”) pursuant to the DMCA by providing our designated Copyright Agent with the following information in writing:
- Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, including any applicable registration number(s) or a representative list of such works if multiple works are involved.
- Identification of the Infringing Material: Sufficient information to permit us to locate the allegedly infringing material. Please provide the specific URL(s) (web addresses) of the content on our Site.
- Your Contact Information: Your full name, mailing address, telephone number, and email address.
- Good Faith Belief Statement: A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
- Accuracy and Authority Statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
- Signature: A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
2. Submitting a DMCA Takedown Notice
Please send your complete DMCA Takedown Notice to our designated Copyright Agent at:
Email: contact@riskyinvests.com (with the subject line: “DMCA Takedown Notice”)
Note: Using a dedicated email address like legal@
or dmca@
is strongly advised as it streamlines the process and demonstrates formal compliance. Using only a general contact@
address can be seen as less formal.
3. Counter-Notification Process
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may send us a counter-notification pursuant to the DMCA.
To be valid, a counter-notification must be in writing and include the following:
- Identification of the Removed Material: Description of the material that was removed and the location (URL) where it appeared before it was removed.
- Your Contact Information: Your full name, mailing address, telephone number, and email address.
- Jurisdiction Consent Statement: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or any judicial district in which RiskyInvests.com may be served if your address is outside of the United States), and that you will accept service of process from the person who filed the original DMCA notice or an agent of that person.
- Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Signature: Your physical or electronic signature.
Upon receipt of a valid counter-notification, we will forward it to the original complainant. The removed content may be replaced, or access to it restored, within 10-14 business days after we send the counter-notice, unless our Copyright Agent first receives notice that the original complainant has filed an action seeking a court order to restrain you from engaging in infringing activity related to the content on RiskyInvests.com.
4. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, RiskyInvests.com has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
5. Modifications to This Policy
We reserve the right to modify, amend, or update this DMCA Policy at any time. Any changes will be posted on this page with an updated “Effective Date.” Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.
